
Background - Employment Discrimination in Maine
While a Maine lawyer will litigate or defend an employment discrimination case filed in Maine, the most significant claims in any such case are likely to be based upon federal anti-discrimination statutes, which are applicable in all fifty states. The primary such claims and statutes are as follows:
o Gender Discrimination, Race Discrimination, Religious Discrimination, and National Origin Discrimination as well as claims of harassment. These claims are based upon Title VII of the Civil Rights Act of 1964.
o Age Discrimination. Claims of age discrimination, generally involving a person over the age of 40, are based upon the Age Discrimination in Employment Act, or ADEA.
o Discrimination against people with Disabilities. Claims of discrimination against people with disabilities are based upon the Americans with Disabilities Act, or ADA.
